SOCIAL SECURITY DISABILITY CLAIMS If you have been out of work for at least 12 months because you are disabled and unable to perform your duties at work, or your doctor has advised you that your disability is expected to keep you out of work for 12 or more months, you may be eligible to receive Social Security Disability benefits (SSD). The first step is to go to your local Social Security office and file a claim. Bring any reports from your physician describing your disability and confirming your condition and your work limitations. The report should be submitted with your claim. Before you go to the Social Security office, call them and ask just what they require for you to file a claim and what papers or documents you should bring with you. If you have filed your claim and receive notification that your claim has been denied, you may appeal that decision and have your case brought to a hearing. At the hearing evidence will be presented including your testimony along with any medical reports supporting your inability to work because of your disability. It is recommended that you have an attorney familiar with SSD law who has had experience in advising and representing clients at appeals hearings to represent you at the hearing. You are advised to contact an attorney as soon as you receive notice that your claim has been denied. The lawyer will meet with you, review the medical reports and prepare your case for the hearing. If you receive notice of a denial of your SSD benefits claim, be sure to act promptly.
